TERMS and CONDITIONS
1. INTRODUCTION
a. The purpose of this document is to regulate the TERMS or CONDITIONS OF PROCUREMENT of the Pre-booking and Booking services whether online or directly (hereafter, and interchangeably, ’Booking’, ‘Pre-booking’ and ‘Online Booking’ services, or ‘services’) of The Stricklin Hotel (TSH), with registered offices in Florence, Alabama, USA. Phone 256-248-9982. The terms “User” is used here to refer to all individuals and/or entities that for whatever reason access www.thestricklin.com or www.stricklinhotel.com and use its services.
b. The use of these services implies full and unconditional acceptance and validity of each and all the Terms and/or Conditions – which are deemed to be automatically incorporated into the contract concluded with TSH, without the need for user written transcription in the same.
By proceeding with the reservation user accepts and agrees with The Stricklin Hotel (TSH) that the reservation (details of which are set out above), if accepted by TSH, shall be on the terms and conditions as follows:
2. RATES AND DEPOSIT
a. The rates quoted are based on user period of stay and are subject to change as a result of changes in user arrival and/or departure dates.
b. Rates quoted are in US Dollars.
c. The rate is for 1 or 2 adults or 1 adult and 1 child only.
d. Rates do not include any applicable prevailing government taxes at the time of occupancy.
e. The maximum number of guests per room is 2. Please contact TSH for more information.
f. In the event user complete a booking based on a rate that has been incorrectly posted, TSH reserves the right to correct the rate or cancel the reservation at its discretion, and will contact the user directly in order to do so.
3. CHECK-IN AND CHECK-OUT TIME
a. Check-in time is after 3:00pm and check-out time is by 11:00am.
b. A valid government-issued identification or passport is required at check-in.
4. EARLY ARRIVAL AND LATE DEPARTURE
a. Should user arrive at TSH prior to the normal check-in time, the user is advised to approach TSH's Guest Services Desk for assistance in storing user luggage until check-in is available.
b. If arriving early, the user is also advised to consider making a reservation for the evening prior to user arrival.
c. Late check-outs are available on request subject to room availability and occupancy level.
d. Please check with TSH's Guest Services at least 24 hours prior to user departure on the availability of late check-out.
e. A half-day room charge may be incurred for late check-out between 12:00pm to 6:00pm and a full-day room charge may be incurred for late check-out after 6:00pm.
5. ELIGIBLE AGE FOR CHECK-IN
A user must be at least 25 years of age to check-in and register for a room.
6. USE OF THE ONLINE PRE-BOOKING AND BOOKING SERVICES
a. The purpose of the Online services is for the reservation of a room at TSN. THE USE OF THESE SERVICES IMPLIES FULL AND UNCONDITIONAL ACCEPTANCE AND VALIDITY OF EACH AND ALL TERMS AND/OR CONDITIONS – WHICH ARE DEEMED TO BE AUTOMATICALLY INCORPORATED INTO THE CONTRACT, CONCLUDED WITH TSH, WITHOUT THE NEED FOR USER WRITTEN TRANSCRIPTION IN THE SAME.
b. Procurement procedure: When using the service, the user will receive an email confirmation in which is included the confirmation that their purchase order is in the process of being confirmed. If you are a customer, once the corresponding debt for your reservation has been made, you will receive an email confirming this; this email serves as proof of your booking.
c. Guarantee: The booking is confirmed and guaranteed overnight with a credit card. In the event of a no-show without prior notice, the first night will be charged (including fee and taxes).
d. Termination of the contract or cancellation of the booking: The credit card is solely a means of guarantee. Cancellation of the booking by the user will not incur any charges for advance cancellation, provided that this is done prior to the specified deadline on the day of arrival. Once this threshold has passed, TSH will make a cancellation charge as compensation, which will amount to the cost of the first night (including fees and taxes.
e. This clause does not apply to bookings made with special rates. In this case, respective specified conditions shall apply.
7. CREDIT CARD CONFIRMATION AND CHARGES
a. A valid credit card is required to secure all reservations.
b. Upon booking a room, credit card will be charged for the amount indicated on the booking confirmation page and email.
c. TSH accepts Visa, Mastercard, American Express, and Discover credit cards.
d. Debit Cards and Diners Club credit cards are not accepted.
e. In proceeding with the reservation, user further agree to allow TSH and its agents to collect, use and disclose to any of its related corporations, its agents and its third party service providers (including those outside of the US) user personal data for the purposes of
(i) administering, managing and maintaining user customer relationship with TSH;
(ii) TSH and its affiliates complying with any applicable law, governmental or regulatory requirements, or request or direction of any governmental authority of any relevant jurisdiction; and
(iii) other business related purposes of TSH and its affiliates.
8. GROUP RESERVATIONS
Reservations for groups of 10 rooms and above, please email TSH at reservations@thestricklin.com.
9. PROTECTION OF THE USER'S PERSONAL DATA
a. Users of Pre-Reservation, Online Reservation, and Online Check-out services offered through www.thestricklin.com or www.stricklinhotel.com, are voluntarily providing personal data (hereinafter, the Personal Data) and expressly, fully, and unreservedly accept that TSH may process these data in an automated way and include them in a file for the purpose of being able to provide and offer its services. TSH is responsible for this file and it is registered with the competent authority.
b. Due to the specific characteristics of the activity and the TSH services, and for the optimal development and achievement of its objectives, it is necessary to transfer personal data to third parties. The transfer of personal data to such entities is for the sole purpose of correctly fulfilling the services offered by TSH.
c. TSH guarantees that it has taken the appropriate security measures at its facilities, in its systems and files. Moreover, TSH guarantees the confidentiality of the personal data, although it will disclose to the competent public authorities the personal data and any other information in its possession or that is accessible via its systems that may be required pursuant to the legal and regulatory provisions applicable to the case. Users of www.thestricklin.com or www.stricklinhotel.com are responsible for the truthfulness, accuracy, validity and authenticity of the personal data provided, and undertakes to keep them duly up to date.
d. TSH services are not intended for minors and TSH does not ask for or collect information regarding underage persons.
e. TSH may collect information via devices such as cookies or log files regarding its users' browsing on www.thestricklin.com or www.stricklinhotel.com. These mechanisms are exclusively associated with one user and their own personal computer. In this case, TSH will only use these data as a whole for the ultimate aim of improving its services. TSH may share this information with its customer companies, although in the same manner and in any case only on a complete and statistical basis.
f. The electronic document in which the reservation is formalized is stored electronically for the period established by law.
g. Operations to check user account data and to request services or products via the TSH website are carried out by means of a secure server. This server's software encrypts the information entered by users before sending it to TSH. Moreover, TSH has strict security procedures regarding the storage and disclosure of data in order to prevent any unauthorized access to this data.
10. . RIGHT TO MODIFY THE GENERAL TERMS AND/OR CONDITIONS OF PROCUREMENT
TSH reserves the right to modify these General Terms and Conditions of procurement by informing users of the changes made via www.thestricklin.com or www.stricklinhotel.com.
11. EXCLUSION OF GUARANTEES AND RESPONSIBILITIES
a. TSH DOES NOT GUARANTEE THE RELIABILITY, AVAILABILITY OR CONTINUITY OF THE SERVICES MADE AVAILABLE TO THE USER, THUS EXCLUDING ANY LIABILITY FOR DAMAGES WHICH MAY ARISE OWING TO A LACK OF AVAILABILITY, RELIABILITY OR CONTINUITY OF ITS WEBSITE OR ITS SERVICES, ALTHOUGH IT WILL TRY TO FACILITATE, TO THE EXTENT OF ITS CAPABILITIES, TECHNICAL SUPPORT FOR THE PERSON AFFECTED, AND WILL TRY TO IMMEDIATELY RECTIFY THE BREAK IN SERVICES, PUTTING INTO PLACE, TO THE EXTENT OF ITS CAPABILITIES, ALTERNATIVE MEANS.
b. TSH DOES NOT UNDERTAKE TO CONTROL AND DOES NOT HAVE ANY PRIOR CONTROL OVER VIRUSES OR ELEMENTS IN ITS CONTENTS WHICH MAY ALTER THE SOFTWARE OR HARDWARE OF THE USER OR OF PERSONS VISITING THE WEB PAGES AND WILL THEREFORE NOT BE LIABLE FOR DAMAGES OF ANY KIND WHICH MAY ARISE FROM THE SAME.
c. IF, DESPITE ACTING WITH DUE FORESIGHT AND DILIGENCE, TSH IS UNABLE TO PROVIDE THE CONTRACTED ROOMS FOR REASONS WHICH ARE NOT ATTRIBUTABLE TO IT AND IF IT IS IMPOSSIBLE TO OFFER THE SERVICES UNDER THE CONDITIONS AGREED, TSH SHALL OFFER THE USER THE OPTION OF A COMPLETE REFUND OF THEIR PAYMENT OR SUBSTITUTION FOR SOMETHING SIMILAR IN NATURE IN TERMS OF CATEGORY OR QUALITY. IF DUE TO SUBSTITUTION THE SERVICE IS OF AN INFERIOR CATEGORY OR QUALITY, TSH MUST REFUND THE DIFFERENCE.
12. APPLICABLE LAW AND COMPETENT JURISDICTION
These Terms and/or Conditions of procurement are governed by Alabama State Law. For the resolution of any dispute arising with respect to its validity, execution, fulfilment or resolution, either total or partial, the users expressly waives their own jurisdiction or any other which, if appropriate, may apply to them and submit to the competence of the Courts of Lauderdale County Alabama. This contract constitutes the full and complete expression of the agreement between TSH and the user and replaces all previous pacts, undertakings, statements or agreements, either written or oral, which may have existed previously between both.
13. FURTHER INFORMATION
a. User may unsubscribe to any such email at any time upon receipt of the said email.
b. No gatherings or parties of any nature are allowed in guest rooms and TSH reserves the right to evict any additional occupants in the room.
c. Reservations are not transferable. Name changes must be requested by the user and must be approved by guest services.
d. By proceeding with the reservation, user further agree and acknowledge that if the reservation is accepted by THS, user stay subsequently shall be subject to TSH’s terms and conditions.
e. TSH may, at its absolute discretion, cancel the reservation if TSH is of the opinion that the reservation information provided is falsified or incomplete.
f. TSH shall be entitled to vary, amend and/or otherwise change these terms and conditions at any time without prior notice.
g. User shall indemnify and hold TSH harmless in respect of any liability, loss, damage, cost and expense of any nature arising out of, and/or in connection with the acceptance of the reservation by TSH.
h. TSH shall not be liable for any losses, damages, costs or expenses incurred by user as a result of any cancellation of the reservation by TSH.
